BPCIA Ethical Issues?

Hi, all,

I’m in the midst of preparing a paper on ethical issues arising from biologics practice, and figured I’d ask:  you have any issues that arise?  I’ve thought of some regarding prosecution bars/competitive decision-making type issues, but would love your input, particular as to in-house counsel issues.

    David, wouldn’t you think designating prior art that tends to invalidate a patent as highly confidential, attorney eyes only, should be per se unethical?

    What about excluding patent prosecutors from meetings where prior art is discussed?

    Then, if the adaption of claims is the reason litigators are barred from IPRs, shouldn’t the scope of the bar be limited to amending claims?
