Note – I have no justification for the 2nd order polynomial trendline that I used except that it satisfies my hope that we have hit some bottom and that things are moving up.

    Mooney has only one sense of “dooty” and he may step in it when he takes that walk. Although the fresh air might do him (and his mom) some good.

    Malcolm,

    I ha_te to burst your bubble, but “ If so, that will the be the last such bubble.” and “I really hope Bilski puts a stake through the heart of this shite won’t happen.

    Business mtheods patents will not and cannot be killed by Bilski and bubbles are just a natural phenom and will continue to happen in the patent world just like in other contexts.

    Not an answer, just an observation.

    you are duty bound to presume the patent’s validity.

    Actually, my sense of “duty” compels me to throw the thing into re-exam and make a big stinking example out of it. Unfortunately, the weather is nice so I’m going to take a nice walk instead.

  4. 15

    Loonie, if you are going to be so judgmental, then you should recognize that you are duty bound to presume the patent’s validity.

    Or would you rather see thousands of underemployed patent prosecutors joining forces with Tea Party America to oppose President Obama?

    If that happened, we’d get AI claiming that as president Barack Obama has a constitutional right to have been born in the United States.

    MM, consider the mischief that patent lawyers might be visiting upon society were business method patenting activities not available to occupy their time. Or would you rather see thousands of underemployed patent prosecutors joining forces with Tea Party America to oppose President Obama?

    Now whether this is true or not is a different story, but those with marketing blood can see the inflating of the next bubble.

    If so, that will the be the last such bubble.

    But seriously: all the rancid heat never escaped the previous bubble. More business method patents are issuing now than ever before.

    1. A method of targeting based on user information, the method comprising:

    identifying a set of keywords associated with content information requested by a user over a network;

    retrieving advertising information corresponding to said set of keywords;

    retrieving user profile information associated with said user, said user profile information comprising a user matrix, said user matrix comprises, for said set of keywords and said corresponding advertising information, click-through-rates associated with said user and a bid price for said advertising information;

    filtering said advertising information to select advertisements based on said bid price for said advertising information and said corresponding click-through-rate associated with said user identified in said user matrix for said set of keywords; and

    providing said advertising information selected to be displayed for said user in connection with said content information.

    I really hope Bilski puts a stake through the heart of this shite. Kappos needs a Supreme face slap about now.

    GetALife,

    If you are done molesting your dog, can I have her?

    Lost Lexus,

    downhill being much steeper than the recovery

    kinda makes sense and fits with the general economic view of a slow recovery. Also notice that the two data sets can almost be perfectly matched up with the reigns of King Kappos and Duffas Dudas.

    What’s going on is that word has gotten out that patents ain’t what they used to be

    It actually appears to be the reverse – Kappos is being seen as reviving patents, the path of destruction by those before him being forsaken.

    Now whether this is true or not is a different story, but those with marketing blood can see the inflating of the next bubble.

    And on a critical note, one problem with a 2nd-order polynomial fit is that the curves are the same going down and up. It looks like these data points could support two separate linear fits, with the downhill being much steeper than the recovery.

  10. 8

    We are not discussing the value of invention, but of patenting activity. Sorry, but the two don’t necessarily move in lock-step.

  11. 6

    What’s going on is that word has gotten out that patents ain’t what they used to be, especially in the electrical arts, even if Kappos is making them a tad less painful to get. If Bilski goes the wrong way, expect that trend line to flip down by year’s end.

    ping,

    I’m guessing you still haven’t gotten that dog.

    You need a hobby my friend – and please don’t tell us about it.

    Thanks

    Dennis, if the reported 4000 recent responses to the PTO’s request for hiring [or re-hiring] people with patent experience as examiners is true, what is going on?

    Baby hair with a woman’s eyes
    I can feel you’re watching in the night
    All alone with me and we’re waiting for the sunlight
    When I feel cold, you warm me
    And when I feel I can’t go on, you come and hold me
    It’s you… And me forever
