Prof. Hricik has a great new post on the USPTO’s Office of Enrollment and Discipline (OED) and its expansive claim to power. Hricik’s post is descriptively titled: The OED Asserts it Has Jurisdiction to Discipline You in Far Broader Circumstances Than You might Think.
OED is a big toothless lion that likes to roar every so often to make sure people still thinks its relevant.
Patent attorneys, as a group, are one of the biggest collection of anal-retentive, rule following geeks you’ll ever find. Given the consequences of losing your ability to practice in a very lucrative business, there is little incentive for anybody to “break the rules.”
