I look askew as to any “partitioning” of innovation (i.e., “diagnostics for medical are “ok,” but any other type of “diagnostic” still is verboten) — in the sense of Divide and Conquer.
Once you start down that path, Big Pharma’s outsized “Voi€e” will not be able to be quieted, and “special rules” will only complicate patent law ever more so.
Does licensee estoppel really have its roots in estoppel by deed? Obviously assignor estoppel has, but it is less clear to me that this is true for estoppel by deed.
